Appointment of judges

A citizen of the State Union of Serbia and Montenegro meeting all requirements for employment with government authorities, who is a Bachelor of Law, has passed the Bar Exam and is worthy of the judge’s function may be elected judge.

The following working experience in legal practice following the passed Bar Exam shall be required:

  • two years for a judge at municipal court;
  • four years for a judge at commercial court;
  • six years for a judge at district court;
  • eight years for a judge at the Court of Appeal, High Commercial Court and Administrative Court;
  • twelve years for a judge at the Supreme court of Serbia.

(Article 41 of the Law on Judges)

 

The judges are appointed by the National Parliament upon proposal of the High Judicial Council, in the procedure prescribed by the Law on Judges, Law on High Judicial Council and the Rules of Procedure of the High Judicial Council.
