Administrative division

At the beginning of 2006, the Administrative Division of the Supreme Court of Serbia was composed of 18 judges and 20 advisers. The Division consists of six panels, acting in cases of general administrative law matters.

The complexity of the administrative maters is evident in the cases such as: protection of the electoral law, extra profit taxes, withdrawal of work license and bank liquidation, privatization of enterprises, public auctions, as well as the cases dealing with public revenue, customs, foreign trade operations and foreign currency transactions etc.

The most common cases in administrative law area are the cases on the legality of final administrative acts issued by Republic administrative bodies in first instance: acts issued by Republic administrative bodies in first instance: acts issued by the Tax Administration of the Ministry of Finance and Economy of the Republic of Serbia (taxes, contributions, utility taxes etc.), as well as the other acts from the Ministry’s competence (restitution, misappropriation of land, expropriation etc.). There are also many cases against the acts issued by other ministries (especially the Ministry of Interior), National Bank of Serbia, Bar Association of Serbia, National Bureau of Employment etc.

The Supreme Court of Serbia hears these cases in first and final instances in a three-judges panel. An appeal against a decision in an administrative dispute ispermitted only in exceptional cases. Such appeal is heard by the Administrative division in a five-judges panel. Such proceedings are closed to the public, however, due to the complexity that a certain disputable matter may entail, or when the Court finds it necessary, in order to have a better presentation of facts, it may decide to hold a hearing.

The Administrative division represented by a threejudges panel hears appeal against judgments issued by district courts in second instance.

A five-judges panels hears appeals on extraordinary legal remedies in examining judgments of the district courts upon the requests for the extraordinary review of a judgment, requests for protection of legality and claims for new trials.

A special panel hears cases on conflict of jurisdiction between the panel for Administrative Disputes within district courts and Litigation panels of district and municipal courts. This panel is composed of the Presidents of Administrative and Civil divisions and the Head of the Case Law within the Administrative division.
