Case law division

In accordance with the Rules on Organization and Work of the Supreme Court, the Case Law Division: follows and examines the case law, initiates re-examining of adopted legal position, proposes to the General Session to adopt legal position on certain legal matter, informs the judges and judge’s assistants of the legal positions taken by different court divisions and principal legal positions of the General Session and determines which data and documentation need to be examined in respect of updating the case law as well as the manner in which recoded, processed and entered into publica tions, in order to secure an uniform court performance.


The President of the Court is also the President of this Division, who determines his/her deputy by the Annual timetable for judges. In addition, this Division is composed of two Deputy Presidents, Editor in Chief of the Bulletin of Case Law, Presidents of the other three court divisions, as well as the Heads of the Case Law Evidence in each division, their deputies and advisors from all divisions.

This Division performs registration and processing of data and judicial decisions on certain legal issues in order to create a uniform database of case law on the Republic level, with free access for all judges in Serbia. Presently, a database of case law of the Supreme Court of Serbia is being compiled and is expected to be presented at the Court’s website.

This Division is authorized to reflect on all irregularities in deliberation of a panel, and to point to any deviation from an adopted legal postition or case law. However, it may not have any influence whatsoever on court adjudication. If the Division has any objection to the deliberation, it may return the disputable judgement back to the panel with a clarification. The President of the panel holds another deliberation and in case the same decision is issued, the case is presented before the General Session of the Supreme Court of Serbia and it then reaches a legal postition on the matter.
