Grand Personnel Council

Grand Personnel Council was established on the basis of the Law on Judges and Law on Organization of Courts.
Council is competent for determination of the reasons for termination of judge’s function, that is, the completion of prescribed years of service and reasons for dismissal of judges (Article 56 of the Law on Judges). Council establishes facts and decides in the proceedings closed to the public.
Manner of work and decision-making of this body is prescribed by the Grand Personnel Council Rules of Procedure.
Council is composed of nine judges of the Supreme Court of Serbia with most years of experiences – three judges from each of the following divisions: the Criminal, Civil and Administrative, appointed for the term of two years. Judges elect the Council president from among Council members.
In the procedure for dismissal on the grounds of unconscientious or unprofessional performance, Council may pronounce to a judge a warning measure or removal from court for the period from one month to one year. Judge has the right to lodge an objection against the pronounced measure to the General Session within eight days. General Session is closed to public. (Article 58 of the Law on Judges)
Warning measure and removal from court are entered in judge‘s personal file. For the duration of measure of removal from court, the status of judge is the same as if he/she were suspended. Warning measure may not be pronounced twice to the same judge. (Article 61 of Law on Judges)
Council Decision may be published in the media only exceptionally, when there are particularly justified reasons, if so agreed upon by the president of the Supreme Court of Serbia and the Council president.
