Reception and Allocation of Cases

Court registry performs tasks of direct reception and allocation of cases.

Allocation of cases in court is random, regardless of the personality of parties and circumstances of the case, according to astronomic time of reception and numeric order of court panels (judges) as established by Аnnual timetable (Article 48 of Court Rules of Procedure).

Allocation of cases is controlled by the president, court secretary or court registry manager.

Derogations from Order of Reception

Change of judge or panel to whom, according to annual timetable, the case should be assigned, may be made for reasons of considerable caseload or the fact that a judge is prevented from acting in the given case, or in case of existence of reasons for exemption by the force of law.

А judge or a panel may be disposed of a case if, acting upon party‘s complaint, it is established that judge or panel unjustifiably delay the proceedings, as well as in case of judge‘s long absence, exemption and change or annual timetable.

Mentioned derogations from the rule of order of reception and allocation of cases are decided on by the court president by a ruling, which can be objected to both by a judge or the panel that should have acted in the case according to the Аnnual timetable, and by the parties to the proceedings.
